There may be other causes of action. Suing states is usually really hard because of sovereign immunity issues. Suing cities is usually easier. I do not know precisely what the Clean Water Act would permit here. But importantly that isn't the same sort of case as a 1983 case. Here they were suing the specific individuals involved for money damages.

Yes, the temperature is measured. And then it is converted into the anomaly graph prominently displayed. The comparison is NOT a matter of actual temperature but rather the difference in anomaly. It is clear that you need to read the report.
