Double Jeopardy only applies once you’ve been found not guilty. The conviction was overturned, but that just throws the case back to the lower court. It’s rare for such a case to be re-tried, but it does happen.

So the “he could go back” part is from the prosecutor saying that he would try to charge him and retry him again if the conviction was thrown out. So, definitely not a lawyer here, but would that not violate Double Jeopardy?
