New Mexico jury finds Facebook liable for deceiving users on privacy, Cambridge Analytica breach
A Santa Fe jury found over 43 million violations of state law, the only state to take the 2018 data breach to trial after Meta's $18 billion multistate settlement excluded the claim.
What to know
- New Mexico is the only state to take Cambridge Analytica-related privacy claims to trial, after Meta's August $18 billion multistate settlement released the company from future liability on that breach.
- The jury found Facebook liable across over 43 million violations of the state's Unfair Practices Act, with penalties of up to $5,000 each still to be set by the judge.
- The verdict follows New Mexico's earlier $942 million in judgments against Meta this year over minor-safety protections, deepening the company's legal exposure in the state.
- Meta says it will keep contesting the findings; a penalty hearing has not yet been scheduled.
“Meta's platforms are forums for free expression. We have a First Amendment right to manage those platforms in a way we believe best serves the interests of our community.”

The New Mexico jury found that @Meta committed an unfair or deceptive trade practice over its statements that Facebook users had control of their data and committed 2.1 million violations — the population of the state of New Mexico.
-
By my math, the New Mexico jury found about 43.2 million violations by @Meta . If the judge awarded the maximum penality to @facebook (that won't happen) that would total about $216 billion.

“The verdict marks a significant victory for New Mexico consumers and holds one of the world's largest technology companies accountable for its conduct.”

Closing arguments wrap up in Santa Fe privacy trial
After two weeks of evidence, attorneys for New Mexico urged jurors to find Facebook liable for thousands of violations of the state's Unfair Practices Act, while Facebook's lawyers argued the state's evidence was outdated.
“We became the product for Facebook. They turned our dreams into data they could sell to advertisers.”

I think the Cambridge Analytica scandal was a big deal, and even used it to reinforce and reprioritize some privacy-focused initiatives at a past job. But I heard some credible voices on social media say that the actual impact was negligible. Anyone know what they mean? Maybe that has some bearing here?

The multi-state settlement was a huge loss for Meta. You are focusing on the money, which is not the important part. The important part is that the settlement just settled that one lawsuit. There are many thousands of individual lawsuits over many of the same issues, mostly by local governments (school districts).Almost all the work the nearly 50…

How is this:> people who want more "regulation"Same as this:> who believe states with high levels of paper regulationI _do_ want real regulations with teeth against shitty companies like Meta. How about real fines? So far all these fines have been "ugh that's one day of net profits only", be it at Google, Apple, Microsoft, Facebook - you name it. Are there kickbacks involved to keep the fines at a minimum?
-
The key to this story is in the word "liable." That's lawyer-speak for a civil, not criminal, legal judgment. The loser must pay money, no one goes to jail, and Meta has so much money that the judgment means nothing.Meta already pays billions to gain access to people's personal data. This is just another business expense, a line item on a balance…

...what's inconvenient about it? The less "regulation" in dem scary quotes there is, the easier it is for companies to shirk them (and cheaper, too). The only actual argument there can be is that that $18 bn fine will have to ultimately come out of the pockets of the Meta's customers, and perhaps that'll force Meta to adopt even uglier business…
