What to know
- The Supreme Court's unsigned shadow-docket order gives no reasoning and leaves the underlying litigation, before Judge Royce Lamberth, ongoing.
- About 1,000 transgender federal inmates will continue receiving hormone therapy and other accommodations for now.
- Only Justices Thomas and Alito indicated they would have sided with the Trump administration; the rest of the bench, including other conservatives, did not join them.
- The order is temporary — DOJ is expected to continue pursuing appeals as the case proceeds toward final judgment.

The order is a narrow, unexplained shadow-docket decision, so the legal fight over trans care in prisons is far from settled.

ACLU and advocates call the order a rare win
Civil rights groups and legal commentators framed the decision as a tentative rejection of what they called an extreme anti-trans legal argument underlying the DOJ's request, while noting the ruling is temporary and unexplained.
“This ruling affirms that federal prison officials can't deny transgender people essential health care.”

Supreme Court denies Trump administration's emergency request
In an unsigned, unexplained order in Trump v. Kingdom, the Court declined to let the Bureau of Prisons immediately enforce the restrictions, leaving Lamberth's injunction in place; Justices Clarence Thomas and Samuel Alito noted they would have granted the request.

Great news! The Trump admin went to the Supreme Court looking for permission to forcibly detransition inmates who have been on hormones for decades, deliberately denying them medical care that their doctors prescribed. Thankfully, the Court refused to grant the request. Alito and Thomas would have.

background
DOJ asks Supreme Court to lift the injunction — After the D.C. Circuit rejected a stay request, Solicitor General John Sauer asked the Supreme Court in late September 2026 to let the Bureau of Prisons immediately implement its new policy ending gender-affirming surgeries, hormone treatment and social accommodations.
-
background
Judge Lamberth blocks the policy with a restraining order — U.S. District Judge Royce Lamberth issued a temporary restraining order roughly 15 days into the administration, later converting it into a preliminary injunction in June 2025 and continuing to enforce compliance, including a contempt threat in February 2026.

background
Trump signs order defining sex as 'biological sex' — On his first day back in office, Trump signed an executive order defining 'sex' as biological sex and directing the Federal Bureau of Prisons to conform its treatment standards for transgender inmates to that definition.
