What to know

  • DOJ wants Washington to set aside ballots from over 400 people, covering 1,500 past votes, out of more than 5 million registered voters in the state.
  • The request mirrors a similar, legally contested demand against California affecting up to 20,000 voters, which a federal appeals panel questioned on constitutional grounds.
  • Prior noncitizen-voter claims by the administration have repeatedly been found to be far smaller than alleged, including zero confirmed cases in Nevada and eight (not 207) in Maricopa County, Arizona.
  • Washington's Secretary of State says the state will only comply with due-process-compliant requests, citing concern about harassment seen in California.

“We take our responsibility to protect voter information seriously and will only respond to requests that follow due process.”

Secretary Hobbs says state will only respond with due process

Washington Secretary of State Steve Hobbs said his office is reviewing the demand, noted roughly 60 prior DOJ subpoenas for voter information since last month, and cited concern about harassment seen in California.

DOJ demands Washington state set aside 400 voters' ballots

The Justice Department sent Washington's Secretary of State's Office a letter identifying more than 400 people it says may have registered without citizenship, accounting for 1,500 votes cast in prior elections, and asked that any ballots they cast in the midterm be set aside pending verification.

“We are asking the state to set aside those ballots until we can confirm they are legal voters.”
    — Neil Floyd, Acting U.S. Attorney

LA County review finds errors in DOJ's suspect list — A Los Angeles County assistant registrar said staff sampled 200 records from the Trump administration's list and found canceled or inactive registrations, people with no voting history, and voters who appeared to have been born in the U.S.

  5. background

Appellate judges question DOJ's California ballot demand — During rare Sunday arguments, a federal appeals panel questioned the timing, constitutionality and authority of the Justice Department's demand that California sequester mail ballots from up to 20,000 suspected noncitizens.
