Archdiocese of Denver says Colorado's universal pre-K program illegally forces it to admit LGBTQ families; Trump administration backs the challenge.
What to know
- St. Mary Catholic Parish v. Roy is argued Nov. 3, 2026, the fourth First Amendment case Colorado has brought to the Supreme Court in a decade, after losing the prior three.
- The Archdiocese of Denver wants an exemption from Colorado's requirement that publicly funded preschools admit all children regardless of sexual orientation or gender identity.
- The Trump administration is backing the Catholic plaintiffs, and the case could further expand the Free Exercise Clause's reach nationally.
- Colorado AG Phil Weiser, who is defending the policy, is simultaneously favored to be elected the state's next governor the same day arguments are heard.
“We've been dealing with these cases against the state of Colorado for more than a decade … and what we've learned is that the state of Colorado is no respecter of the First Amendment”

Trump administration backs Catholic preschools before argument
Jerusalem Post reports the Trump administration is supporting the Archdiocese of Denver's bid for an exemption, framing the case as a test of whether the court's conservative majority will keep expanding Free Exercise Clause protections against Colorado's LGBTQ nondiscrimination mandate.
“These cases reflect a very conservative court, following the conservative agenda on the religion clauses and LGBT issues…”

Case framed as test of Colorado's First Amendment losing streak
Washington Examiner notes this is the fourth time in a decade Colorado has faced the Supreme Court over alleged First Amendment violations, after losses in Masterpiece Cakeshop, 303 Creative, and this year's 8-1 Chiles v. Salazar ruling. Religious-liberty lawyers argue Colorado keeps testing the limits of its leeway to exclude religious groups.
“It doesn't seem like Colorado has gotten the message…”

SCOTUSblog previews Nov. 3 argument in Colorado preschool case
Amy Howe outlines the dispute: Catholic preschools say they want the same exemption Colorado extends to other selective preschools, while Colorado says any participant must accept the program's equal-opportunity nondiscrimination agreement. The 10th Circuit had ruled for the state, finding the requirement neutral and generally applicable rather than a targeted burden on religion.
“simply want the same accommodation extended to them.”

www.cbsnews.com/news/supreme... We've got to increase SCOTUS to 13 so we can shut down these creeps. There's no way they should be allowed to reject students this way. The whole public funds to non-public schools is a scam. #USDemocracy

This should be open and shut. Public funds means you serve the public, no matter what they look like. If you don't like what what that entails, you can go back to being a private pre-k.
