Actually yes he can. Clinton era DOJ thought so - premise being that the president cannot be indisposed during a civil trial, eg what happens if POTUS is in a closed door deposition and something like 9/11 hits…that was the logic behind their memo SCOTUS added on that POTUS gets immunity for official acts, but has not addressed the Clinton era DOJ…

Jack Smith emerges as surprise witness for BBC, who could expose secret evidence in Trump's defamation lawsuit. Trump is scared, and fighting to stop Smith from testifying. This is huge! Smith can spell a lot of beans about trump when he couldn’t anywhere else. Stayed toned.

Indeed. I'm wondering if the publicity angle is the one to go on. He will have made 100s of comments about how they made stuff up, but having lost the law suit (either on a technically or on merits) the bbc can now claim that he caused them damages with all his misleading statements and lies.

BREAKING: A federal judge has ordered President Trump to sit for a deposition in his $10 billion defamation lawsuit against the BBC or risk the case getting dismissed, according to the AP.

Just like they'll rationalize him defying a judge's order to sit for a deposition. "He's being persecuted for doing the right thing" or some other idiotic bullshit the make up to make him the hero of the story in their heads.
-
It's more than case dismissal if the judge grows a pair of balls. Contempt of court, filing false accusations, or even mandate him to be jailed/held as material witness till the next appointed court date to ensure he doesn't miss it.
-
Nah, I'm fine with that. After seeing a similar deal cut with Karla Homolka and then honoured it makes me understand that sometimes deals like this have to be broken when the truth is that staggering.
